Agreement Between User and Selforganizer
The service given to you (user) on the Web site ("www.selforganizer.com") is conditioned on your acceptance of these Terms of Use. Your use of this Web site constitutes your agreement to the Terms of Use.
Modification of These Terms and Conditions
Selforganizer reserves the right to change the terms, conditions and notices under which this Web site is offered.
Personal and Noncommercial Use Limitation
Selforganizer is for your personal and noncommercial use. You may not copy, modify, distribute, display, perform, create derivative works from, transfer or sell any information, software, products or services obtained from Selforganizer.
Service obligations and liability:
Selforganizer will do its best to provide a prompt and continuing service but will not be liable for any loss of data resulting from delays, non-deliveries, missed deliveries, or service interruptions caused by events beyond the control of Selforganizer, or by errors or omissions of the customer. Selforganizer specifically excludes any warranty as to the accuracy of information received through the service.
All conditions or warranties which may be implied or incorporated into this contract by law or otherwise are excluded to the extent permitted by law. In no circumstances whatsoever will Selforganizer be responsible for economic, indirect or consequential loss.
Selforganizer strictly states that shall not be reliable for any:
- direct, indirect, special or consequential damages, resulting from the use
- inability to use the service
- cost of procurement of substitute goods and services
- resulting from any goods or services purchase
- unauthorized access
- damages for loss of profits, use, data or other intangible
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages so some of the above limitations may not apply to you.
Term, Suspension, Termination or Cancellation of Service
This contract shall be for a term of 1 year from the date of purchase/renewal of the subscription by the Customer or the contract is terminated in accordance with the given terms.
The 'Seven day cooling-off period' and associated right to cancel, as defined by The Consumer Protection Act (Distance Selling) Regulations 2000, will not apply to this transaction as signup gives instant access to the service.
Selforganizer may suspend or terminate the service immediately and without prior notice, on breach of any of the terms and conditions of this contract.
No Unlawful or Prohibited Use by the Customer:
The Customer acknowledges that it may only use the service for lawful purposes. The Customer warrants that:
- they shall not (or authorise or permit any other party to) use the service to receive or transmit material which is in violation of any law, regulation or which is obscene, threatening, menacing, offensive, defamatory, in breach of confidence, or otherwise unlawful;
- as the registered user of the account will keep all allocated username(s) and password(s) secure and not let them become public knowledge and that the password(s) will not be stored anywhere on a computer in plain text;
- all information they provide, including during service application, will be accurate and correct;
- any breach of these obligations shall entitle Selforganizer to immediately terminate the Service to the Customer without notice.
The Customer hereby agrees to fully indemnify and to hold Selforganizer harmless from and against any claim brought by a third party resulting from the use of the service by the Customer and in respect of all losses, costs, actions, proceedings, claims, damages, expenses (including reasonable legal costs and expenses), or liabilities, whatsoever suffered or incurred directly by Selforganizer in consequence of the Customer's breach or non-observance of these terms and conditions.
The Customer shall defend and pay all costs, damages, awards, fees (including any reasonable legal fees) and judgments awarded against Selforganizer arising from the above claims and shall provide Selforganizer with notice of such claims, full authority to defend, compromise or settle such claims and reasonable assistance necessary to defend such claims, at the Customer's sole expense.
Disclaimer of Warranties
The user agrees that, although Selforganizer will try to do whatever possible, the use of the service is at members sole risk. The service is provided on as is and as available basis.
Selforganizer makes no warranty that the service will meet your requirements or that the service will be uninterrupted, error free. Nor does make any warranty as to the results that may be obtained from the use of the service or as to the accuracy or reliability of any information obtained through the service.
The customer understands and agrees that any material and/or data downloaded obtained through the use of the service is done at the customers own risk and that the customer will be responsible for any damage to customers computer system or loss of data that results from the downloaded materials.
Data Protection
The Customer agrees that we may put his name and other information obtained about him from his subscription and the sales process into a computerized directory for internal use only.
Note that no personal details will be passed from us onto other companies, organizations or individuals not connected with servicing his subscription.
Selforganizer reserves the right to vary these terms and conditions at any time with prior notice to the Customer.
The Customer acknowledges that it has read and accepts the terms of this contract. Use of the service by the Customer shall be deemed acceptance of the terms of this contract.
